POLICY ON CHANGES IN AUTHORITY, OWNERSHIP, OR MANAGEMENT Policy: The Agency will comply with all State and Federal regulation regarding the reporting of any Change of Authority, Ownership, or Management in time manner. Procedure: 1) We will disclosure of persons having controlling interest or ownership of greater then 5%, and as owner will comply with Conflict of Interest regulations. 2) We will disclosure of persons with controlling interest, or managing employees convicted of criminal offenses against Medicare, Medicaid, or the title V (Maternal and Child Health Services) and title XX (Social Services) programs. 3) As disclosing entity our Agency will furnish updated information to CMS at intervals between recertification, or re-enrollment, or contract renewals, within 30 days of a written request. Disclosure of a change in authority, ownership, or management within 30 days. a) Persons holding senior management positions and owners will be consistent with CMS 855A information. 4) In accordance with Federal regulations, if any MERGE surge for our Agency to another available Agency, the merger of a provider corporation into another corporation constitutes a change of ownership. In this case of the merger we will retains our existing provider agreement and provider number. 5) Voluntary Terminations, in accordance with Federal Regulations, we may voluntarily terminate our provider agreement by filing a written notice of our intention to the Agency for Health Care Administration (AHCA), in turn, notifies the CMS and Medicare regulatory body Office. As CMS recommendations we will provide a discharge comprehensive assessment for each patient prior to the effective date of the termination. 6)In the case that we sells our Agency (including asset sales or stock transfers), transfers or relinquishes ownership of the Agency within 36 months after the effective date of we enrollment in Medicare, we accept that our provider agreement and Medicare billing privileges do not convey to the new owner. We will advise to the prospective provider/owner of the Agency instead: · (i) Enroll in the Medicare program as a new Home Health Agency, and .
