SCREENING FOR COMPLIANCE WITH BACKGROUND SCREENING/SCREENING OF HOME HEALTH AGENCY PERSONNEL POLICY: All prospective MDT Home Health Care Agency, Inc. field staff members will be screened as required by Florida legislation. Our Agency performs a check of the Office of Inspector General Exclusion List, (ensures that personnel are not on the Office of the Inspector General Exclusion List if they provide services to beneficiaries of the Medicare/Medicaid program). criminal background record (level 2) and national sex offender registry, at the time of hire, for each personnel that has access to patient records or provides direct patient’s care/service. PROCEDURES 1. All direct care staff will be checked in the Sex Offender list on-line, all direct care staff or those with access to patient’s records will be checked on the OIG exclusion list on-line, will receive a copy of the Level 2 Criminal History Check form for his or her completion ( Screening Validation for LiveScan Vendor ). a. All direct care staff or those with access to patient’s records is responsible for any fees, required to process this information. 2. The Administrator or designee will submit these forms to the Agency For Health Care Administration (AHCA) - Background Screening Unit Department with his or her name, any other information requested, and fees necessary. a. This information is required within five (5) days of employment. b. No field employee will be assigned any patient’s care until a non-offense results is received from the authorized screening agency. 3. All direct care staff or those with access to patient’s records signs an Affidavit of Compliance with Criminal Background Check for Purposes Relevant to Chapter 408.809 and Chapter 435, F.S.(See Affidavit of Compliance with Criminal Background Form), which be used by the Administrator or designee to assist in screening applicant and will remain in the applicant’s personnel file. 4. The Administrator / designee will receive from the Background Screening Unit Department an approval letter for all personnel that have been cleared. The Administrator/designee will be held responsible to take action to assign any employee/contractor to client’s contact, only after a non- offense result is received by the screening unit. 5. Upon the receipt of the renewal application of the Home Health Care Agency, the Administrator/ Designee will be responsible to sign an Affidavit of Compliance with Screening requirements starting that all new non-licensed and applicable licensed personnel employed, have submitted the screening request to the Screening Unit and the date of submission, if they are still awaiting results, and that the agencies remaining personnel have worked for the Home Health Care Agency continuously. 6. Our Agency will recheck criminal background history and the sex offender registry on all personnel that provide direct patient care/service at least every 5 years. 7. It is or policy that all personnel with access to personnel/clients files will have criminal background checks, OIG exclusion list registry check up, and national sex offender registry. 8. Our Agency will under special circumstances, analyzes case by case, for hiring a person convicted of a crime. The analyzes will include, but are not limited to: documentation of special considerations, restrictions, or additional supervision. 9. All results (OIG, Sexual Abuse registry, and Criminal background) will be kept in the employee file in a confidential envelope. Home Health Agency. - - Personnel/Operations Policies B-39
