MDT Home Health Care Agency, Inc. MEAL PERIOD Reference: Fair Labor Standards Act (FLSA) POLICY: Employees scheduled to work more than five (5) consecutive hours are entitled to a minimum of one-half hour unpaid meal period. PROCEDURES: A. Time is allotted for a meal period. It is the responsibility of the Employee to take the meal break. B. Time taken for the meal period is unpaid when the Employee is completely relieved of duties. C. If the meal period is interrupted by the need to return to work, then the meal period is paid time. D. The Supervisor or designee should assure that Employees working more than five (5) consecutive hours in a day receive a meal break. E.
