POLICY ON COMPLIANCE WITH FEDERAL, STATE AND LOCAL LAWS POLICY : MDT Home Health Care Agency, Inc. is in compliance with all applicable Federal, State and County laws and regulations. GEOGRAPHIC SERVICE AREA: Our geographic services area, covered of the professional staff which takes into account the projected number of clients, supervision of the staff, cover: State: Florida County(ies): Miami Dade & Monroe In compliance with Federal, State, and local laws and regulations related to the health and safety of patients, our Agency and its staff will operate and furnish services in compliance with all applicable federal, state, and local laws and regulations related to the health and safety of patients. Our HHA will maintain State issue license to operate. Disclosure of ownership and management information. Our Agency will comply with the requirements of part 420 subpart C. Our HHA also will disclose the following information to the state survey agency at the time of the HHA’s initial request for certification, for each survey, and at the time of any change in ownership or management: (1) The names and addresses of all persons with an ownership or controlling interest in the HHA as defined in § 420.201, § 420.202, and § 420.206 of this chapter. (2) The name and address of each person who is an officer, a director, an agent, or a managing employee of the HHA as defined in § 420.201, § 420.202, and § 420.206 of this chapter. (3) The name and business address of the corporation, association, or other company that is responsible for the management of the HHA (if any), and the names and addresses of the chief executive officer and the chairperson of the board of directors of that corporation, association, or other company responsible for the management of the HHA. Licensing. Our HHA, its branches (if any), and all persons furnishing services to patients must be licensed, certified, or registered, as applicable, in accordance with the state licensing authority as meeting those requirements. Laboratory services. (1) If our HHA engages in laboratory testing outside of the context of assisting an individual in self ‐ administering a test with an appliance that has been cleared for that purpose by the Food and Drug Administration, the testing must be in compliance with all applicable standards. Our HHA will not substitute its equipment for a patient’s equipment when assisting with self ‐ administered tests. (2) If our HHA refers specimens for laboratory testing, the referral laboratory must be certified in the appropriate specialties and subspecialties of services in accordance with the applicable requirements. Care of individuals with limitations: All admission’s paper work, Patient Information are distribute in English and Spanish (bilingual), as applicable, according to our community area of services, which fall in these two main languages. Also, the Agency will adhere to all applicable federal, state and local laws, regulations and guidelines with respect to providing reasonable accommodations as required to afford equal opportunity to qualified handicapped individuals. PROCEDURE 1. Definitions: A. Handicapped individual. Any person who has, or who has acquired a physical or mental impairment which limits one or more major life activities, such as self care, performing manual tasks, seeing, hearing, speaking, breathing, and working on a temporary or permanent basis. B. Physical or mental impairment. Any physiological disorder, disfigurement, or anatomical loss or limitation, or any mental or psychological disorder acquired as a result of illness, accident or birth.
