MDT Home Health Care Agency, Inc. Services under arrangement. (1) Our HHA will ensure that all services furnished under arrangement provided by other entities or individuals meet the requirements of section 1861(w) of the Act (42 U.S.C. 1395x (w)). (discharges the patient the liability to pay for the services) (2) We will have a written agreement with another agency, with an organization, or with an individual when that entity or individual furnishes services under arrangement to the HHA’s patients. Our Agency will maintain overall responsibility for the services provided under arrangement, as well as the manner in which they are furnished. The agency, organization, or individual providing services under arrangement may not have been: (i) Denied Medicare or Medicaid enrollment; (ii) Been excluded or terminated from any federal health care program or Medicaid; (iii) Had its Medicare or Medicaid billing privileges revoked; or (iv) Been debarred from participating in any government program. (3) Our agency is responsible for patient care, and must conduct and provide, either directly or under arrangements, all services rendered to patients. Our Agency will be ready for 24 hours operation trough our Administrator or Director of Nursing, Clinical Manager (or qualified designee) 24 hrs pager/cellular, or On-call services company. (Regular Office business hours are from 9:00 am to 5:00 pm, Monday-Friday). Care, services and products are provided within an established time frame, as specified by organizational policy, organizational standards, medical directives or individual physician orders. Consideration is given to the client and/or family needs in scheduling and providing care. Home health care administration staff maintains administrative control and established lines of authority for the delegation of responsibility (See Organizational Chart). PURPOSE: To define home health care staff areas of responsibility. PROCEDURES 1.The home health care agency governing body assumes full legal authority and responsibility for operation of the agency. 2.The Administrator of Home Health Care Agency assumes responsibility for overall administrative and supervisory functions and overall operations of the Home Health Care Agency. Our Administrator and the Director of Nursing, Clinical Manager, or their alternates, will be available to the public for any eight consecutive hours between 7 a.m. and 6 p.m., Monday through Friday of each week, excluding legal and religious holidays. Available to the public means being readily available on the premises or by telecommunications; and when the administrator and the Director of Nursing, Clinical Manager are not on the premises during designated business hours, a staff person must be available to answer the phone and the door and must be able to contact the administrator and the Director of Nursing, Clinical Manager by telecommunications. This individual can be a clerical staff person. 3.The Director of Nursing, Clinical Manager of our Home Health Care Agency reports directly to the Administrator, and is responsible for our quality assessment and performance improvement program (QAPI program) 4.In the absence of the Administrator of Home Health Care Agency, the Alternate Home Health Agency Policies A-8
