MDT Home Health Care Agency, Inc. DRUG AND ALCOHOL TESTING POLICY: MDT Home Health Care Agency, Inc. strives to provide a safe work environment and encourages personal health. In this regard, MDT Home Health Care Agency, Inc. considers the abuse of drugs as a serious threat to our staff and customers. The ultimate goal of this policy is to balance our respect for individual privacy with the need to keep a safe and drug free environment. It is MDT Home Health Care Agency, Inc.’s policy that an Employee found with the presence of illegal drugs and/or alcohol in his/her system, in possession of, using, selling, trading, or offering for sale illegal drugs during working hours, may be subject to written corrective action up to and including, termination of employment. PROCEDURE: ·Substance abuse includes possession, use, purchase or sale of drugs on work premises (including parking lots). It also includes reporting to work under the influence of drugs or alcohol. ·Drugs prescribed by an Employee’s physician may be taken during work hours. The Employee should notify the Supervisor if the use of properly prescribedmedication will affect the Employee’s work performance. ·Abuse of prescription drugs will not be tolerated. ·An Employee or job applicant will be allowed to provide notice to MDT Home Health Care Agency, Inc. of current or recently used, prescription or non-prescription drugs at the time of the taking of the specimen to be tested and such information shall be placed in writing upon the drug and alcohol testing custody form prior to initial testing. ·All information, interviews, reports, statements, memoranda, and test results, written or otherwise, received by MDT Home Health Care Agency, Inc. through its drug and alcohol testing program are confidential communications, except under certain circumstances as allowed by Federal or State statute. ·As a condition of employment, Employees must abide by the terms of this policy and must notify MDT Home Health Care Agency, Inc. in writing of any conviction of a violation of a criminal drug statute occurring no later than five (5) days after such conviction. · DRUG TESTING: It is a condition of employment for all Employees to refrain from reporting to work or working with the presence of drugs or alcohol in his or her body and to submit to drug screening. Drug Screening will occur when: When there is any mishap or accident involving the Employee in which injury to self has required outside medical treatment by a physician. Where there is a physical injury or abuse to a patient/resident requiring outside medical treatment by a physician. Where there is reasonable suspicion. Many State laws provide for a denial of Worker’s Compensation benefits for Employees who are injured while working and subsequently test positive. REASONABLE SUSPICION TESTING a. Where there is reasonable suspicion to believe, in the opinion of the company, that an Employee is under the influence of intoxicants, drugs or narcotics or that an Employee has a measurable quantity of intoxicants, drugs or narcotics in blood or Home Health Agency. - - Personnel/Operations Policies B-154
