MDT Home Health Care Agency, Inc. RELEASE OF INFORMATION FROM CLINICAL RECORDS POLICY The clinical records of a client are the property of the Home Health Care Agency and are maintained for the benefit of the client, the physician and the Home Health Care Agency. It si the responsibility of the Home Health Care Agency to safeguard the information on the clinical record against loss, tampering or use by unauthorized personnel. Clinical records of a client may be removed from the safekeeping and jurisdiction of the Home Health Care Agency only in accordance with a court order, subpoena or statue, in which case copies will be made for presentation to the court. Original records must never leave the Home Health Care Agency premises without approval of the Administrator. CONSENT FOR THE RELEASE OF CONFIDENTIAL INFORMATION Consent for the release of confidential information must be in writing and signed by the client or legal guardian if the client has been adjudicated incompetent to manage his or her personal affairs, or an Attorney adlitem (court - appointed to protect interest of another) appointed for the client, or a personal representative if the client is deceased. The written consent must specify the following: 1.The information or clinical records to be covered by the release, 2.The reasons or purposes for the release, and 3.The person to whom the information is to be released. The client, or other person authorized to provide consent, has the right to withdraw their consent to the release of any information at any time. Such withdrawal must be in writing. No information should be released after consent has been withdrawn. ALL FILES WILL KEPT FOR THE DURATION OF FIVE YEARS. Clinical records shall be maintained for five (5) years, for all adults patients, minors clients records will be retained for a minimum of (5) five years after the age of majority is reached, Client records involved in litigation are retained until after settlement.
