STANDARDS FOR THE STRUCTURE, MANAGEMENT AND OPERATION OF A HOME HEALTH AGENCY Our Agency and our personnel are in compliance with all applicable Federal, State and County laws and regulations. To be in fully compliance with the Management of the Home Health Agency we follow: A. STRUCTURE OF A HOME HEALTH AGENCY The accepted professional standards and principles that our Agency and our staff must comply with include, but are not limited to: • Home Health Agency Federal regulation, • State Practice Act, (Florida State: Agency for Health Care Administration: AHCA) • Commonly accepted health standards established by national organizations, boards, and councils (i.e., the American Nurses, Association standards) • The Americans with Disabilities Act • Equal Employment Opportunities Act • Fair Labor Standards Act • Title VI of the Civil Rights Act of 1964 • Occupational Safety and Health Standards (OSHA) • Medicare regulations, if applicable • Medicaid regulations, if applicable • HIPAA • US Food and Drug Administration (FDA), if applicable • Drug Enforcement Administration (DEA), if applicable • Other laws and regulations as applicable to the care/service provided by the organization • Our own policies and procedures • Accreditation Standards, if applicable 1. Legal authorization: The agency is legally authorized to operate in a specific geographic area (Miami Dade County(ies) ) and has: a. Articles of incorporation or other charter document (Occupational and other licenses) b. Bylaws (with all services that we may provide) c. Written statement of purpose, philosophy d. State of Iicensure 2. Responsible management: There is a legally constituted governing body accountable for the responsible management of the agency: a. Board competition: The Board is made up of representative of the community. b. Board functions: The overall responsibilities of the governing body include: 1. Employment and evaluation of an executive director or administrator 2. Determination and evaluation of agency policy and programs 3. Responsibility for fiscal policies, accountable decisions 4. Delegation of program to appropriate professional and office staff. 3. Administrative staff a. Administrator: A health professional with major educational background and health care administration experience, or qualified person with experience in health care administration. b. Director of Nursing, Clinical Manager: a health professional with education and experience in community health practice and administration. c. Organizational Chart: Reflects the channels of authority and the relationships of units and personnel to one another. 4. Budget and financing: a. Board members and administrative staffs, including a representative of patient services, participate of budget. b. The budget clearly reflects programs and services priorities for the fiscal year. 7
