MDT Home Health Care Agency, Inc. EXEMPT EMPLOYMENT STATUS REFERENCE: FAIR LABOR STANDARDS ACT POLICY: It is the policy of MDT Home Health Care Agency, Inc. to ensure salary exempt Employees are paid in compliance with the Fair Labor Standard Act (FLSA). PROCEDURE: · Prior to placing an Employee in a salary exempt status, the President must be consulted for approval. · For an individual position to meet the FLSA salaried exempt requirements, the Employee must meet the duty and salary tests as specified by law. · Salary exempt Employees shall be paid a regular salary for all hours worked. · Salary exempt Employees requested to work a sixth or seventh day for direct care responsibilities will qualify to receive an additional pay on a “per visit” basis. · Salary exempt Employees, who are absent for a partial day, will not have their salary reduced unless otherwise specified by law. · Salary exempt Employees, absent from work for a full day, must request PTO time for that day. · Salary exempt Employees record hours worked for accounting purposes only.
