MDT Home Health Care Agency, Inc. FAMILY/MEDICAL LEAVE OF ABSENCE Reference: Family and Medical Leave Act of 1993 POLICY: An eligible Employee may request a leave of absence for any of the reasons identified below for up to twelve (12) weeks in a twelve (12) month period with job protection and no loss of previously accumulated service or any company benefits, provided the Employee returns to work at the end of the leave period. An Employee may not work another job while taking leave. ELIGIBILITY A. An eligible Employee, is any Employee, who meets all of the following conditions: Must have completed twelve (12) months of service for MDT Home Health Care Agency, Inc. (not necessarily consecutive months) and; Worked at least 1,250 hours during twelve (12) month period immediately preceding the leave request. QUALIFIED LEAVE Under this policy, an eligible Employee may take FMLA qualified leave for any of the following reasons: · Because of the birth of a child or to care for the child within 12 months of the date of birth; · Because of the adoption or foster care of a child within 12 months of the date of placement; To care for an Employee’s spouse, child or parent who is incapable of self-care because of a mental or physical disability or serious health condition; Because of the Employee’s serious health condition that renders the Employee unable to perform the essential functions of his or her job. A serious health condition is defined as a condition which requires inpatient care at a hospital, hospice, or residential medical care facility, including any period of incapacity or any subsequent treatment in connection with such inpatient care or condition which requires continuing care by a licensed health care provider. ENTITLEMENT A. MDT Home Health Care Agency, Inc. will grant up to twelve (12) weeks of leave during a twelve (12) month period. B. The twelve (12) month period is measured backward from the date the Employee takes leave. C. Each time an Employee takes leave, the amount of Family Medical Leave (FMLA) the Employee has taken during the past twelve (12) months will be subtracted from the twelve (12) weeks of available leave. The balance remaining is the amount of time available under the Family Medical Leave Act. D. Utilizing PTO days does not extend the twelve-week leave period, but PTO is inclusive of the twelve-week period. NOTICE: 1. Employees should provide at least thirty (30) days advance written notice of the need to take FMLA when the need for such leave is foreseeable. 2. When unable to provide thirty (30) days advance notice, the Employee must give notice as soon as practicable. 3. Failure to provide thirty (30) day written notice of the need for FMLA, if the leave is foreseeable, may result in the delay of leave until thirty (30) days after notice is given. MEDICAL CERTIFICATION A. When leave is taken because of a serious health condition of the Employee or family member, the Employee will be required to provide medical certification to substantiate the need for FMLA from Home Health Agency. - - Personnel/Operations Policies B-134
