MDT Home Health Care Agency, Inc. an attending health care provider. The medical certification must be provided every thirty (30) days. B. Employees should provide the required medical certification within fifteen (15) calendar days of the request from MDT Home Health Care Agency, Inc. Failure to timely provide the requested certification may result in the delay of leave until the certification is received. C. MDT Home Health Care Agency, Inc. reserves the right to ask for a second opinion. D. MDT Home Health Care Agency, Inc. will select a second physician and pay for the cost of the certification from the physician. E. If it is necessary to resolve a conflict between the original certification and the second opinion, MDT Home Health Care Agency, Inc. may request the opinion of a third physician. F. MDT Home Health Care Agency, Inc. and the Employee will jointly select the third physician and MDT Home Health Care Agency, Inc. will incur the cost. G. The third opinion will be considered final. BENEFIT STATUS: A. PTO will not continue to accrue during a leave greater than one month. B. Employees must pay in advance his/her portion of the health and dental insurance premium while on leave. (if the economic situation of the Agency permit to provide Health insurance coverage) C. The cost of the Employees’ premium can be obtained by contacting the Human Resource Department. (if the economic situation of the Agency permit to provide Health insurance coverage) D. Payment must be received by the end of the fifth (5 th ) of each month. E. Payment should be submitted to the Human Resource Department. F. While on FMLA, MDT Home Health Care Agency, Inc. will continue the Employees’ health benefits during the leave period. If the Employee chooses not to return to work for reasons other than a continued serious health condition or other circumstances beyond the Employee’s control, the Employee will be required to reimburse MDT Home Health Care Agency, Inc. for the total cost (Employer and Employees cost) of the health insurance premiums during the leave period. G. Employees must utilize PTO while on FMLA: Employees receiving MDT Home Health Care Agency, Inc.-sponsored disability income insurance must utilize available PTO for the waiting period and a portion of each week. The total combined benefits paid shall not exceed the average weekly wage. Employees not receiving MDT Home Health Care Agency, Inc.-sponsored disability income insurance must exhaust available PTO. RETURN TO WORK A. An Employee who returns prior to the exhaustion of the twelve (12) weeks of FMLA will be returned to the same position held when leave commenced, or to an equivalent position with equivalent benefits and pay. B. An Employee who has taken FMLA because of a personal serious medical condition will be required to provide a medical certification of fitness to return to work. C. An Employee must notify his/her Supervisor a minimum of one week in advance of his or her expected return. D. An Employee who fails to report for work or contact his or her Director or Supervisor by their expected date of return will be considered to have abandoned his/her job. E. An Employee’s employment status will become inactive when he/she is unable or fails to return to work following the exhaustion of twelve (12) weeks of Family Medical Leave. INTERMITTENT LEAVE: A. An Employee may take FMLA, under certain circumstances, intermittently or use the leave to reduce the work-week or workday, resulting in a reduced hour schedule. B. In all cases, the leave may not exceed a total of twelve (12) weeks over a rolling twelve (12) month period. C. If an Employee is salaried, during a reduced or intermittent leave the Employee’s salary will be reduced based on the amount of time actually worked. D. The Employee may be temporarily transferred to an available alternative position with Home Health Agency. - - Personnel/Operations Policies B-135
