An Employee is entitled to an intermittent or reduced leave in the event of a serious health condition of self, a family member, or to leave for his/her newborn or adopted child. F. When an intermittent or reduced leave is required for a serious health condition with planned medical treatment, the Employee is required to make every reasonable effort to schedule treatment so that disruption to MDT Home Health Care Agency, Inc. operation is minimized. PROCEDURE: A. The Employee must review, initial each page, and complete the FMLA policy and procedure required form (s) and submit it to his/her Supervisor at least thirty days prior to the leave date. B. The Human Resource Department should be contacted for questions about FMLA or the completing of the necessary paperwork. C. The Director will review the form, sign and date it upon receipt and forward a copy to the Human Resource Department. D. A representative from the Human Resource Department will contact the Employee to explain the policy and benefit status during FMLA. E. If FMLA is due to the birth or adoption of a child, the Employee is responsible for contacting Human Resource within two weeks of the birth or adoption to have the child added to the health insurance plan, if desired. F. Failure to notify Human Resource of the addition of the child may result in benefit ineligibility for the child until the open enrollment period. G. The Employee shall contact the Human Resource Department at least one (1) week prior to return, giving the date and time of his/her return to work. H. The Employee should contact Human Resource Department at least every thirty (30) days to confirm FMLA status. Where applicable, an updated medical certification will be requested. I. If the need for leave was a result of the Employee’s serious medical condition, a physician’s statement releasing the Employee to return to work will be provided to the Human Resource Department prior to the Employees return to work. RESERVATION OF RIGHTS: A. MDT Home Health Care Agency, Inc. reserves the right to amend, modify, or eliminate this policy at any time as long as said changes are consistent with state and federal law. B. This policy incorporates by reference all sections and provisions of FMLA, to the extent that the policy and FMLA differ, FMLA would govern.
