MDT Home Health Care Agency, Inc. RIGHTS OF THE EMPLOYEE/JOB APPLICANT a. An Employee or job applicant who receives a positive confirmed drug test may contest or explain the result to the Administrator within five (5) days of receipt of the written test results. b. The Employee or job applicant has the right to consult the DON, Clinical Manager for technical information regarding the effects of prescription medication on a drug test. c. An Employee or job applicant may at their own expense, by written request, have their specimen retested at the laboratory of their choice. CONFIDENTIALITY 1. Testing and test results shall be handled confidentially with disclosure of results provided to the Human Resources Manager or designee. 2. Upon request, Employees shall be provided a copy of their test results. 3. In the event of a positive drug/alcohol test that will result in termination, such results will be disclosed to the Supervisor, President and to the Agencies responsible for administering workers compensation and unemployment compensation benefits (if necessary). CONCLUSION · MDT Home Health Care Agency, Inc.’s drug-free policy is not intended to be abusive or discriminatory nor to come into conflict with any public policy. · MDT Home Health Care Agency, Inc. considers drug testing to be only one of several steps to achieve a safe, healthy and productive atmosphere for its Employees. · This policy is available for inspection by the job applicant or the Employee during regular business hours. · This policy supersedes any information provided to applicants and/or Employees either written or oral and reserves the right to change the provisions of this policy and testing program at anytime in the future.
