This agency's personnel who refuse to work with other personnel or patients either suffering or suspected of suffering from HIV infection should be referred to the infection control coordinator by their supervisor. The infection control coordinator shall provide these individuals with the latest information concerning HIV infection, its transmission, and adequate safeguards against transmission, as necessary. This agency's personnel who have a reasonable basis for refusal (such as pregnancy or undergoing chemotherapy) may be offered a temporary or permanent transfer if such is available. 5. Any of this agency's personnel suffering from HIV infection shall be eligible for employee benefits (such as disability and workers' compensation) in the same manner as any other employee who may be entitled to such benefits. III Applicants for Employment 1. Persons offered employment shall complete a health screening questionnaire which shall include a question as to whether or not he/she suffers from or is susceptible to any immunity disorder. 2. Persons diagnosed with immunity problems may be considered for employment the same as any other applicant, based on their experience, qualifications, abilities to perform the job, and other appropriate factors. Persons diagnosed with immunity problems may be required to obtain medical clearance from their physicians. Our infection control coordinator will provide instructions and education as necessary. The same policy guidelines regarding assigned duties as stated in this Policy in Section Ill (1) shall apply. IV. Employees or Applicants with Other Disabling or Infectious Diseases 1. Applicants for employment with confirmed or suspected disabling or infectious diseases other than AIDS shall be considered for employment as described in Section III of this Policy. 2. The policy guidelines contained herein regarding continuing employment, assigned duties, eligibility for benefits and employee education shall apply to facility employees either confirmed or suspected of having a disabling or infectious disease other than AIDS. V. Policy on Infection Committee on Infectious Diseases It is the policy of this agency that an ad hoc infection committee shall be established from time to time to advise our administration on medical matters pertaining to patients and employees or applicants offered employment with infectious, disabling, or contagious diseases (including HIV infection). Each such ad hoc infection advisory committee shall include at least the infection control coordinator, together with other appropriate professionals. The committee shall consider all available medical information regarding the employee's or applicant's condition, and shall provide advice to this agency's administration regarding such matters as the individual's ability to perform or to continue to perform the job, the significant risks of infection to others (particularly patients), and job positions where the individual might work without significant risk to the individual. The committee shall consult with this agency's legal counsel as necessary, provide findings and recommendations to the appropriate administrative officers, and otherwise maintain the information it receives and its findings and recommendations in a confidential manner.
