AMERICANS WITH DISABILITIES ACT (ADA) Reference: Americans with Disabilities Act of 1990 POLICY: MDT Home Health Care Agency, Inc. is committed to complying fully with the Americans with Disabilities Act (ADA) and ensuring equal opportunity in employment for qualified persons with disabilities. All employment practices and activities are conducted on a non-discriminating basis. PROCEDURE: · Post job offer physical examinations and questionnaires of Employees shall only be conducted after a conditional offer of employment is made. · Job descriptions shall clearly define the essential functions of the position. · If the applicant or Employee has a disability that prevents the applicant or Employee fromperforming the essential job functions of the position, the Administrator or Director of Nursing, Clinical Manager, with the President, and the Human Resource Department must determine if a reasonable accommodation is available that would enable the applicant or Employee to perform the essential job functions, or if the accommodation would impose an undue hardship on operations. · ADA accommodation requests or other ADA issues are to be referred to the Human Resource Department who will notify management. Each accommodation request should be documented, including the subsequent action taken. · Reasonable accommodations are available to disabled Employees according to the guidelines outlined in Section C of this policy, where their disability affects the performance of the essential job functions. · Qualified individuals with disabilities are entitled to equal pay and other forms of compensation (or changes in compensation) as well as in job assignments, classifications, organizational structures, position description, lines of progression, and seniority. Leaves of all types will be available to all Employees on an equal basis. · This policy is neither exhaustive nor exclusive.
