MDT Home Health Care Agency, Inc. MILITARY LEAVE OF ABSENCE Reference: Uniformed Services Employment and Re-Employment Right Act (USERRA) POLICY: A Military Leave of Absence will be granted to Employees, except those occupying temporary positions, to attend scheduled drills or training or if called to active duty with the U.S. Armed Services. The leave will be unpaid, however, the Employee may use any available PTO for the absence. PROCEDURE: A. To be entitled to the provisions of this policy, the Employee (or an appropriate officer of the uniformed service in which Employee is to perform services) must give advance written or verbal notice of the need for leave to MDT Home Health Care Agency, Inc. B. MDT Home Health Care Agency, Inc. requests an Employee seeking military leave to complete a leave request. C. The only exceptions to the written or verbal notice requirement arise where: (1) Such notice is precluded by military necessity, as defined by applicable law, or (2) The giving of such notice is impossible or unreasonable. D. Service with MDT Home Health Care Agency, Inc. will be accumulated, and past service protected, during military leave. E. Subject to the terms, conditions and limitations of the applicable plans for which the Employee is otherwise eligible, health insurance benefits will be provided by MDT Home Health Care Agency, Inc. until the end of the month which Military Leave begins. F. An Employee who elects to continue insurance coverage under this section and who are on Military Leave for a period past thirty-one (31) days, are responsible for the full costs of these benefits if they wish coverage to continue. G. Benefit accruals will be suspended during any leave greater than one month and will resume upon the Employee’s return to active employment. H. An Employee on leave for fewer than thirty-one (31) days in the uniformed services are required to return to work for the first regularly scheduled workday after the end of training, allowing reasonable travel time. I. An Employee returning to work whose period of service was for more than thirty (30) days but fewer than one hundred and eighty-one (181) days must submit an application for re- employment no later than fourteen (14) days after completing the period of service. J. An Employee returning to work whose period of service was for more than one hundred and eighty (180) days must submit an application for re-employment no later than ninety (90) days after completion of service. K. Upon release from active Military Service, the Employee will be returned to his/her former position, unless: · If the Employee’s job is of such a nature that it must be permanently replaced, then MDT Home Health Care Agency, Inc. will attempt to return the Employee to a comparable position with all the rights and benefits the Employee enjoyed before leave was taken. If a position is not available upon return, MDT Home Health Care Agency, Inc. will offer the Employee the first substantial equivalent position that becomes available.
